Welcome to Pagenflow ("we," "us," or "our"). By accessing or using our email builder service at email.pagenflow.com (the "Service"), you agree to be bound by these Terms of Service ("Terms").
1. Acceptance of Terms
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
2. Account Registration and Access
2.1 Account Creation
- You must provide accurate, complete, and current information during registration
- You are responsible for maintaining the security of your account credentials
- You must be at least 16 years old to use the Service
- One person or legal entity may not maintain more than one free account
2.2 Account Types
We offer both free and paid subscription tiers. The features available to you depend on your subscription level, as detailed on our pricing page.
3. Template Ownership and Usage Rights
This is important - please read carefully:
3.1 Your Content Ownership
You retain full ownership of all email templates and designs you create using Pagenflow. This means:
- Any email template you build with our Service belongs entirely to you
- You own all rights, title, and interest in your created content
- You may use your templates for any lawful purpose, commercial or personal
- Your ownership rights exist regardless of whether you're on a free or paid plan
3.2 Commercial and Personal Use
- Personal Use: You may use templates you create for your own personal communications, projects, or businesses
- Commercial Use: You may use templates you create for commercial purposes, including:
- Email marketing campaigns for your business
- Client work (if you're an agency or freelancer)
- Products or services you sell
- Any revenue-generating activities
3.3 What You Can Do With Your Templates
You are free to:
- Export your templates as HTML or React code
- Modify your templates without restriction
- Use your templates across unlimited projects
- Share your exported code with team members or clients
- Use your templates indefinitely, even if you cancel your subscription
3.4 What You Cannot Do
You may not:
- Resell or redistribute Pagenflow itself as a competing product
- Use our component library or pre-built templates to create a competing email builder service
- Claim that templates created with Pagenflow were built from scratch without using our Service (when relevant attribution would be appropriate)
- Remove or obscure any Pagenflow branding from templates on free plans (if applicable)
3.5 Template Usage and Compliance
You are solely responsible for how you use exported templates.
If you use your templates to send emails:
- You must comply with all applicable email marketing laws (CAN-SPAM, GDPR, CASL, etc.)
- You must include proper unsubscribe mechanisms
- You must honor opt-out requests
- You must have consent to email recipients (where required)
- You are responsible for your own privacy policy and data practices
Pagenflow is a design and code export tool only. We do not send emails, manage subscriber lists, or handle email delivery. All email sending activities are your responsibility.
3.6 Client Work and Agencies
If you're a freelancer or agency:
- You may create templates for clients and deliver them the final HTML/code
- Clients own the templates you create for them (subject to your agreement with them)
- You cannot share or transfer your Pagenflow account access to clients
- Clients must have their own accounts to edit templates directly in Pagenflow
4. Subscription Plans and Billing
4.1 Free Plan
- Free plan users have access to basic features as outlined on our pricing page
- Free plan usage is subject to the limitations described on our website
- We reserve the right to modify free plan features with reasonable notice
4.2 Paid Subscriptions
- Paid plans unlock additional features and remove certain limitations
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law or expressly stated in these Terms
- Prices are subject to change with 30 days' notice to existing subscribers
4.3 License Model Clarification
Important: Your subscription unlocks features, not ownership
- Free users and paid subscribers alike own the templates they create
- Paid subscriptions grant access to advanced features (such as additional components, export formats, or usage limits)
- Canceling your subscription does not revoke ownership of templates you've already created
- You may continue to use previously exported templates after cancellation
4.4 Team and Multi-User Licenses
- Team plans allow multiple users within your organization to access the Service
- The number of users (seats) is determined by your subscription tier
- Team licenses may not be shared across separate businesses or organizations
- All team members must comply with these Terms
4.5 Cancellation and Refunds
- You may cancel your subscription at any time
- Cancellation takes effect at the end of your current billing period
- No refunds will be provided for partial subscription periods except where required by law
- Upon cancellation, you retain access to paid features until the end of your billing period
5. Acceptable Use Policy
You agree not to use the Service to:
- Create templates for illegal purposes or fraudulent activities
- Design content that violates any applicable laws or regulations
- Infringe upon intellectual property rights of others
- Upload viruses, malware, or other harmful code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service or servers
- Scrape or copy our component library to build a competing service
- Abuse or overload our systems through automated means
Important Note: Pagenflow is a template building tool only. We do not send emails on your behalf. Once you export your templates, you are responsible for how you use them and for complying with all applicable email marketing laws if you choose to send emails using your templates.
6. Intellectual Property
6.1 Pagenflow's Intellectual Property
- The Service, including all software, features, and functionality, is owned by Pagenflow
- Our logo, trademarks, and branding remain our exclusive property
- You may not copy, modify, or create derivative works of the Service itself
6.2 Component Library and Templates
- Our pre-built components and starter templates are provided for use within the Service
- You may use these components in your email templates
- The underlying code and design system remain our property
- Templates you create using our components belong to you (as stated in Section 3)
6.3 User-Generated Content
- By creating templates, you grant us a limited license to display and store your content for Service operation
- We will never claim ownership of your templates
- We will not use your templates for marketing purposes without your explicit permission
7. Third-Party Services and Integrations
7.1 Export Integrations
- The Service may allow you to export templates to third-party email platforms (Mailchimp, Klaviyo, etc.)
- Your use of third-party services is subject to their own terms and policies
- We facilitate export/import but do not send emails or access your email lists
- We are not responsible for the actions or policies of third-party services
7.2 Export Formats
- Exported HTML and React code is provided "as-is"
- We strive for compatibility but cannot guarantee perfect rendering in all email clients
- You are responsible for testing exported templates before using them
- What you do with exported templates (including sending emails) is your responsibility
8. Data and Privacy
8.1 Your Data
- We collect and process data as described in our Privacy Policy
- You retain ownership of all data you input into the Service
- We use industry-standard security measures to protect your data
8.2 Template Data
- Email templates you create are stored securely on our servers
- You may export and download your templates at any time
- Upon account deletion, your templates will be permanently deleted within 30 days
9. Service Availability and Modifications
9.1 Service Uptime
- We strive to maintain 99.9% uptime but do not guarantee uninterrupted access
- Scheduled maintenance will be announced in advance when possible
- We are not liable for damages resulting from service interruptions
9.2 Changes to the Service
- We may modify, update, or discontinue features at any time
- Material changes will be communicated to users in advance
- Continued use of the Service after changes constitutes acceptance
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
- SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY, SO THESE MAY NOT APPLY TO YOU
11. Indemnification
You agree to indemnify and hold Pagenflow harmless from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of third parties
- Content you create or send using templates from the Service
12. Termination
12.1 Termination by You
- You may terminate your account at any time through your account settings
- Upon termination, you may export your templates before account deletion
12.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- You abuse the Service or harm other users
- Your account has been inactive for an extended period (free accounts only)
12.3 Effect of Termination
- Upon termination, your access to the Service will cease
- You retain ownership of templates you've already exported
- We may delete your account data after termination
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Cameroon, without regard to conflict of law principles.
13.2 Arbitration
Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
13.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class actions.
14. General Provisions
14.1 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Pagenflow.
14.2 Severability
If any provision of these Terms is found invalid, the remaining provisions remain in effect.
14.3 Assignment
You may not assign these Terms without our consent. We may assign our rights without restriction.
14.4 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.

15. Updates to These Terms
We may update these Terms from time to time. Material changes will be communicated via:
- Email notification to registered users
- Prominent notice on the Service
- Update to the "Last Updated" date at the top of this document
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
By using Pagenflow, you acknowledge that you have read and understood these Terms of Service and agree to be bound by them.
